These Terms and Conditions govern all purchases, deliveries, warranties, financing arrangements, and interactions with The Home Furniture Outlet ("THFO," "we," "us," or "our"). By placing an order, visiting our store, or accepting delivery of any product, you ("Customer," "you," or "your") agree to be fully bound by these policies. Please read them carefully before completing any purchase.

SECTION 1 — GENERAL TERMS OF PURCHASE

1.1 Agreement to Terms

By completing a purchase at The Home Furniture Outlet — whether in-store, by phone, or through any other channel — the Customer acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this document. These terms are binding and enforceable.

1.2 All Sales Are Final

All purchases made at The Home Furniture Outlet are final. We do not offer refunds, returns, or exchanges once an order has been placed and fulfilled. This policy applies to all products, including but not limited to furniture, mattresses, accessories, floor models, and special-order items.

Delivery fees, assembly fees, service charges, and any additional fees collected at the time of purchase are non-refundable under all circumstances.

1.3 Customer Dissatisfaction

Customer dissatisfaction, personal comfort preference, color variation, or incorrect measurements taken by the Customer do not qualify as product defects and are not eligible for refunds, exchanges, or returns. Customers are encouraged to measure their space thoroughly before purchase.

1.4 Product Appearance

Product colors, textures, and dimensions displayed in-store, on samples, or in photographs may vary slightly from the actual item received. These minor variations are inherent to furniture manufacturing and do not constitute a defect.

1.5 Floor Models & As-Is Items

Floor models and items sold as-is are sold in their current condition. Customers purchasing floor models or as-is items acknowledge and accept the product in its present state. These items are non-refundable and non-exchangeable. No warranty is provided on floor models unless explicitly stated in writing at the time of purchase.

SECTION 2 — ORDER CANCELLATIONS

2.1 Cancellations Before Delivery

Orders that have not yet been delivered or picked up may be eligible for cancellation under the following conditions:

  • A 30% cancellation and restocking fee will be deducted from the total purchase price.

  • The remaining 70% will be issued as store credit only — no cash, debit card, or credit card refunds will be processed.

  • Store credit must be applied toward a future purchase at The Home Furniture Outlet and has no cash value.

  • Delivery charges that have been scheduled or processed prior to cancellation are non-refundable.

2.2 Customized & Special Order Items

Customized products and special order items are non-cancelable, non-refundable, and non-exchangeable under all circumstances. This includes, but is not limited to:

  • Custom sofas with special-order fabrics or configurations

  • Custom finishes or dimensions

  • Manufacturer-special orders placed on behalf of the Customer

These items are produced exclusively for the Customer and cannot be resold. Once an order for a customized item is placed and confirmed, it is considered final.

2.3 Same-Day Cancellation or Reschedule Fee

If a Customer requests to cancel or reschedule a scheduled delivery on the same day as the delivery, a fee of $49.00 will be charged directly to the Customer's account on file. This fee is non-refundable.

2.4 No Response — Deemed Cancellation

Prior to a scheduled delivery, THFO will make reasonable attempts to confirm the appointment. If we are unable to reach the Customer within 24 hours of the scheduled delivery window, we will assume the order has been cancelled. Standard cancellation terms will apply.

SECTION 3 — DELIVERY POLICY

3.1 Local Delivery Coverage

The Home Furniture Outlet provides delivery services exclusively within the state of Arizona. We do not offer delivery outside of Arizona at this time.

3.2 Delivery Confirmation & Advance Notice

THFO will contact the Customer by phone at least 24 hours prior to the scheduled delivery date to confirm the appointment and provide an estimated delivery window (e.g., between X:00 PM and Y:00 PM). It is the Customer's responsibility to ensure they are reachable and available during this window.

3.3 Adult Presence Required

An adult who is 18 years of age or older must be present at the delivery address to accept the delivery. If no qualifying adult is present at the time of delivery, the team will not complete the delivery. A re-delivery fee will apply, and the original delivery charge is non-refundable.

3.4 Floor Level Disclosure

Customers must clearly disclose the floor level (first floor, second floor, third floor, etc.) where items will be placed at the time of scheduling. Accurate floor information is required to ensure the appropriate number of delivery team members are assigned. Providing inaccurate floor information may result in rescheduling of the delivery and/or additional fees.

3.5 Entryway & Size Responsibility

It is solely the Customer's responsibility to measure all entryways, hallways, doorways, staircases, and interior spaces prior to scheduling delivery to confirm that items will fit. THFO is not responsible for items that cannot be brought inside due to size constraints or layout limitations.

If an item cannot fit through an entryway or into the intended space, THFO's delivery team will place the item at the threshold or as close to the doorstep as safely possible. Delivery is considered complete at that point. THFO will not perform structural modifications to the Customer's property for any reason.

3.6 Pathway Clearance

Customers must ensure that all pathways, hallways, and the designated placement area are cleared of fragile items, obstacles, and other furniture prior to the arrival of the delivery team. THFO is not responsible for damage to personal property or existing belongings caused by failure to clear the space adequately.

3.7 Delivery Completion

Delivery is considered complete once the item has been placed at the agreed-upon threshold or interior location. THFO will not move existing furniture, modify door frames, or remove walls or fixtures. Any damages to the Customer's property resulting from failure to prepare the space are not the responsibility of THFO.

3.8 Missed Delivery

If no qualifying adult is present at the delivery address during the scheduled delivery window, our team will attempt to contact the Customer by both phone call and text message. If the Customer does not respond, the delivery will not be completed and a re-delivery fee will be charged to the Customer's account. The original delivery fee is non-refundable.

3.9 Customer Pickup

Customers who choose to pick up their furniture directly from The Home Furniture Outlet are fully responsible for the item from the moment it leaves our premises. THFO is not responsible for any damage that occurs during customer transport, loading, unloading, or handling after pickup.

The following requirements apply to all pickup orders:

  • Advance Notice Required: Customers must contact THFO ahead of time to notify us of their intended pickup date and approximate arrival time. This allows our team to prepare the order in advance. Walk-in pickups without prior notice may be subject to wait times or rescheduling.

  • Proof of Purchase Required: The Customer must present their original receipt or valid proof of purchase at the time of pickup. Orders will not be released without verification.

  • Customer Inspection: Customers are responsible for inspecting all items prior to transport. Any manufacturer defect concerns must be reported to THFO within 72 hours of pickup. After this period, the product is considered accepted in its current condition.

3.10 Third-Party Pickup Authorization

If the purchasing Customer is unable to pick up the order themselves and wishes to authorize another individual to do so on their behalf, the following must be provided to THFO prior to the pickup date:

  • The full first and last name of the authorized pickup person

  • A valid phone number for the authorized pickup person

  • A copy of the original purchase receipt

The authorized individual must present valid photo identification matching the name provided at the time of pickup. THFO reserves the right to refuse release of any order if the above requirements are not met or if the individual's identity cannot be verified.

3.11 Haul-Away — Not Available

The Home Furniture Outlet does not offer haul-away, removal, or disposal of old furniture or mattresses under any circumstances. Our delivery team will not remove, take, or transport any existing items from the Customer's property. Customers are responsible for arranging removal of old items prior to delivery.

THFO does not purchase, accept, or deal in used furniture or mattresses of any kind.

SECTION 4 — ASSEMBLY POLICY

4.1 Assembly Services

Where assembly is included in the Customer's order, assembly will only be performed after the item has been successfully delivered to a suitable interior space. Assembly will not be performed outdoors, in garages, in hallways, or in any space deemed unsuitable or unsafe by the delivery team.

4.2 Assembly Limitation

If an item cannot be placed in the intended interior area due to size constraints or entryway limitations, assembly will not be performed. In such cases, delivery is still considered complete once the item is placed at the threshold, and assembly fees are non-refundable.

SECTION 5 — PRODUCT INSPECTION & DEFECT REPORTING

5.1 Delivery & Assembly Orders — Photo Documentation

For all orders delivered and assembled by The Home Furniture Outlet delivery team, a full inspection of the product is performed at the time of delivery. Our team documents the condition of all items with photographs taken at the time of delivery and installation. These photographs serve as official confirmation that the product was delivered in proper, defect-free condition.

Because products delivered and assembled by THFO are inspected and documented at the time of delivery, post-delivery defect claims related to condition-at-delivery will be evaluated against this documentation.

5.2 Customer Pickup Orders — 72-Hour Window

For orders picked up by the Customer, it is the Customer's responsibility to inspect the product prior to transport. If a manufacturer defect is discovered, the Customer must notify The Home Furniture Outlet within 72 hours of pickup. After the 72-hour window, the product will be considered accepted in its current condition, and claims may no longer be eligible for review.

5.3 Reporting a Defect

To report a potential manufacturer defect, Customers must contact THFO as soon as possible through one of the following methods:

  • Phone call to the store

  • Text message to the store contact number

  • Email to our customer service address

  • In-person visit to the store

Customers must provide the following when submitting a defect claim:

  • Photos and/or video clearly showing the issue

  • Original purchase receipt

  • A description of the defect or concern

5.4 Defect Review Process

All defect claims will be reviewed by a THFO team member on a case-by-case basis. Claims are evaluated in coordination with the manufacturer. Possible resolutions may include repair of the defective component, replacement of parts, or full product replacement, depending on the manufacturer's determination.

Refunds are not guaranteed and will only be issued when deemed appropriate following manufacturer review and approval. Customer dissatisfaction, comfort preference, or buyer's remorse do not constitute a manufacturer defect.

SECTION 6 — WARRANTY POLICY

6.1 Comfort Pedic Mattresses

Comfort Pedic mattresses carry a manufacturer warranty ranging from 1 to 4 years, depending on the specific mattress model purchased. Customers should inquire at the time of purchase regarding the specific warranty term applicable to their mattress. All warranty claims must be handled directly with the manufacturer and require proof of purchase.

6.2 MLILY Mattress Limited Warranty

MLILY products include a Limited Manufacturer Warranty. Warranty coverage varies by product:

  • 10-Year Warranty — select product lines

  • 5-Year Warranty — select product lines

  • 3-Year Warranty — select product lines

Adjustable bases include a 10-year warranty on the frame and a 2-year warranty on electronics and motors.

The MLILY warranty applies only to the original purchaser and does not cover:

  • Misuse or abuse of the product

  • Failure to follow provided care instructions

  • Normal wear and tear, including rips, tears, or soiling

  • Fabric stains or damage

  • Mattresses not fitted with an appropriate mattress protector

  • Products used for commercial, institutional, or rental purposes

  • Normal changes in softness or resilience, including impressions less than 1 inch in depth

  • Damage caused by uneven or improper support

  • Products sold as-is, floor samples, or received as promotional items

  • Personal comfort preference changes

All law tags must remain attached to MLILY products for warranty claims to be processed. The original receipt serves as proof of purchase.

6.3 MLILY Shelf-Life Requirement

All MLILY products must be opened and fully expanded within 300 days of the purchase date. Failure to properly open and expand the product within this timeframe voids the manufacturer warranty. Products should be stored in a cool, dry environment, away from direct sunlight and excessive humidity, until opened.

6.4 Customized Sofa Warranty

Customized sofas include a 2-year limited warranty covering the structural frame and stitching only. This warranty does not cover fabric wear, stains, damage caused by misuse, or any issues arising from improper handling or care.

6.5 Products Without Warranty

All other furniture products sold at The Home Furniture Outlet do not include a warranty unless otherwise explicitly stated at the time of purchase. Customers are strongly encouraged to inspect these items within 72 hours of delivery or pickup, as THFO cannot guarantee resolution of concerns reported after this period.

SECTION 7 — FINANCING POLICY

7.1 Third-Party Financing

The Home Furniture Outlet offers financing options through independent third-party financing providers. Financing is provided exclusively by these third-party lenders and is subject to their individual approval processes, terms, interest rates, and repayment schedules. Financing approval is not guaranteed and is determined solely by the lender.

7.2 THFO Not Responsible for Financing

The Home Furniture Outlet is not a lender and is not responsible for any aspect of the financing relationship between the Customer and the third-party financing provider. Once a purchase has been completed and delivery has been fulfilled, THFO has no involvement in, responsibility for, or authority over the Customer's financing account, payment schedule, or balance.

7.3 Customer Responsibility for Payments

Customers who utilize third-party financing are solely responsible for making all payments directly to the financing provider on time and in accordance with their financing agreement. A THFO team member will explain the financing terms at the time of purchase and may assist in initiating the application, but ongoing payment responsibility rests entirely with the Customer.

For questions regarding payments, interest, account balances, or financing terms, Customers must contact their financing provider directly. THFO cannot make, modify, defer, or accept financing payments on behalf of any financing company.

7.4 Financing Does Not Alter Sales Terms

The use of third-party financing does not alter, waive, or override any of THFO's sales, refund, delivery, or warranty policies. All purchases made using financing are subject to the same terms as any other purchase.

SECTION 8 — STORAGE & ABANDONED ORDERS

8.1 Storage Fees

If a Customer is unable to accept delivery within 14 days of the original scheduled delivery date, THFO reserves the right to charge a storage fee of $20 to $40 per day, depending on the size and quantity of items being stored. THFO will notify the Customer before storage fees begin to accrue.

8.2 Abandoned Orders

Orders that have not been scheduled for delivery or pickup within 30 days of the purchase date may be considered abandoned. THFO reserves the right to cancel abandoned orders, and standard cancellation terms will apply. No store credit or refund will be issued for abandoned non-customized orders. Customized or special-order items that are abandoned are non-refundable under any circumstances.

SECTION 9 — CHARGEBACK & DISPUTE RESOLUTION

9.1 Customer Agreement Prior to Purchase

By completing a purchase, the Customer confirms they have reviewed and agreed to all applicable store policies, including those governing delivery, refunds, warranties, and financing. This agreement is obtained prior to or at the time of sale and is documented on the Customer's purchase invoice.

9.2 Chargeback Protection

Initiating a chargeback with a financial institution after voluntarily completing a purchase and agreeing to THFO's policies — without a valid, documented basis — may be considered fraudulent activity. THFO reserves the right to dispute any chargeback with full supporting documentation, including signed agreements, delivery photos, and purchase records.

9.3 Dispute Resolution

In the event of a dispute, Customers agree to contact THFO directly to attempt resolution before escalating to any third party, financial institution, or regulatory body. THFO will make reasonable efforts to address legitimate concerns in good faith and in a timely manner.

SECTION 10 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, The Home Furniture Outlet shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the purchase, delivery, assembly, or use of any product. THFO's total liability to the Customer shall not exceed the purchase price of the item in question.

THFO is not responsible for any personal injury, property damage, or loss arising from Customer misuse of products, failure to follow care or assembly instructions, or improper installation performed by the Customer or a third party.

SECTION 11 — IDENTITY VERIFICATION & RIGHT TO REFUSE SERVICE

11.1 Identity Verification for Card Payments

For purchases made with a credit card or debit card — whether completed in-store or over the phone — The Home Furniture Outlet reserves the right to request valid proof of identity to verify that the card being used belongs to the Customer presenting it. Acceptable forms of identification include:

  • Government-issued driver's license

  • State-issued photo ID

  • U.S. or foreign passport

This measure is in place to protect our Customers against unauthorized card use and to protect THFO against fraudulent transactions. Failure or refusal to provide acceptable identification when requested may result in the transaction being declined.

11.2 Right to Refuse Service

The Home Furniture Outlet reserves the right to refuse service to any individual or party at our sole discretion, in accordance with applicable law. This includes, but is not limited to, situations involving suspected fraud, aggressive or threatening behavior toward staff, inability to verify identity for card transactions, or any other circumstance that THFO deems contrary to the safe and lawful operation of our business.

SECTION 12 — PRIVACY & COMMUNICATIONS

By providing your contact information to The Home Furniture Outlet, you consent to receive communications regarding your order, delivery scheduling, and store promotions via phone, text message, and email. THFO will not sell or share your personal information with unaffiliated third parties, except as required to fulfill your order (e.g., financing providers) or as required by law.

SECTION 13 — CUSTOMER ACKNOWLEDGMENT & SIGNATURE

By placing an order with The Home Furniture Outlet, the Customer confirms that they have read, understood, and agreed to all terms, conditions, and policies set forth in this document, including:

  • General Terms of Purchase & All Sales Final Policy

  • Order Cancellation & Restocking Fee Policy

  • Delivery, Assembly & Entryway Policies

  • Product Inspection & Manufacturer Defect Reporting Policy

  • Warranty Terms (Comfort Pedic, MLILY, Custom Sofa)

  • Financing Disclaimer & Third-Party Lender Policy

  • Identity Verification & Right to Refuse Service Policy

  • Privacy & Communications Policy
